Is it Advantageous to Renew a Trademark before the New Regime?

On September 28, 2018, the Canadian Intellectual Propriety Office announced that the modifications to the Trademarks Act and the implementation of the new Trademarks Regulations will enter into effect at the start of 2019.

The new regime will introduce new parameters to the process of renewing a trademark. Before these changes are implemented, it is possible for certain trademark owners to renew their marks now. This is particularly advantageous for marks with multiple classes of goods/services, because additional fees are going to be introduced for each class of goods/services under the new regime. Moreover, the period of validity for a trademark registration is changing from 15 to 10 years.

Below, please find a table summarizing the different possible scenarios for renewing a trademark, assuming the new regime enters into effect on January 1, 2019:

  1. What happens if the renewal date is before the change of regime, but the application for renewal is filed after?
  2. What happens if the renewal date is after the change of regime, but the application for renewal is filed before?
  3. Finally, what happens if both the renewal date and the application for renewal occur after the change of regime?

3) Both the renewal date and the application for renewal occur after the change of regime January 2, 2019 January 2, 2019 New Law:

$400 for the first class when filed on-line ($500 in all other cases)

$125 for each additional class

10 years Classification according to Nice Agreement is required upon filing application for renewal. Goods/services ought to be grouped and classified accordingly. Any unpaid fees will result in cancellation of registration.
